On Truth Social, he pledged the effort would “not in any way hinder or stifle” AI’s growth but would police “BAD” behavior with “our already existing Criminal and Civil Justice System.”

There’s no budget, no timeline, and no home agency. What there’s instead is a doctrine, articulated the same weekend by OSTP director Michael Kratsios on Fox News Sunday: “AI regulation should be use case and sector specific.” Kratsios pointed to drone delivery, self-driving vehicles, and medical diagnostics as lanes where existing agencies already own the file. Translation for small businesses running AI-assisted outreach or pricing: how you use it, not that you use it, determines federal exposure.

That’s the structural read. No new federal disclosure regime is landing this quarter. But the operative risk hasn’t moved. FTC Section 5 authority still covers undisclosed AI pricing and accuracy claims, and the state patchwork is arriving on schedule: Colorado’s revised ADMT and AI chatbot rules land September 23, the FTC’s AI pricing comment window closes September 25, and Senator Cruz’s preemption markup deadline hit this week without resolving whether Washington will override any of it.

The czar shortlist tells its own story about elite psychology. David Sacks left in March and per Axios likely won’t return; names circulating include Scott Kupor, Sriram Krishnan, Chamath Palihapitiya, Sean Cairncross, and Emil Michael, though divestment rules may push the pick toward an insider.
